N.R.S. 293.12757 - Qualification to sign petition

Overview of Statute

This section provides the qualification required to sign a petition.

Statute

If a person is qualified to register to vote and has properly completed any method authorized by the provisions of this title to register to vote:

1. The person may sign a petition required under the election laws of this State on or after the date on which the person is deemed to be registered to vote pursuant to NRS 293.4855, 293.517 or 293.5235, sections 5.1 to 9.8, inclusive, of this act, section 6 of the 2018 Ballot Question No. 5, the Automatic Voter Registration Initiative, or any other provision of this title; and

2. The county clerk shall use the date prescribed by subsection 1 for the purposes of the verification of the person’s signature on the petition.

Except as the term is used in NRS 293.393, whenever the term “county clerk” is used in this title it means “registrar of voters” in those counties where such office has been created pursuant to the provisions of NRS 244.164.

2. Definition for Clerk

Definition [Clerk]

The election board officer designated or assigned to make the record of the election in the roster, tally list and challenge list in the precinct, district or polling place in which such officer is appointed.

3. Definition for State

Definition [State]

A state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands or any territory or insular possession subject to the jurisdiction of the United States.

4. Definition for Ballot

Definition [Ballot]

The record of a voter’s preference of candidates and questions voted upon at an election. The term includes, without limitation, any paper given to a voter upon which the voter places his or her vote and any electronic storage tapes.

5. Definition for Person

Definition [Person]

1. A natural person;

2. Any form of business or social organization;

3. Any nongovernmental legal entity, including, without limitation, a corporation, partnership, association, trust, unincorporated organization, labor union, committee for political action, political party and committee sponsored by a political party; or

4. A government, governmental agency or political subdivision of a government.
