§ 163-82.27. Help America Vote Act of 2002.

Overview of Statute

Section defines the term “Help America Vote Act of 2002” in addition to recognizing the State Board’s authority to adopt certain rules and enforce the minimum requirements of the Act.

Statute

As used in this Chapter, the term “Help America Vote Act of 2002” means the Help America Vote Act of 2002, Public Law 107-252, 116 Stat. 1666 (2002), codified at 42 U.S.C. §§ 15481-15485 [52 U.S.C. §§ 21081-21085]. Citations to titles and sections of the Help America Vote Act of 2002 are as they appear in the Public Law. The State Board shall have the authority to adopt rules and guidelines to implement the minimum requirements of the Help America Vote Act of 2002.

Definition [board]

The term “board” means the State Board with respect to all candidates for State, legislative, and judicial offices and the county board of elections with respect to all candidates for county and municipal offices. The term means the State Board with respect to all statewide referenda and the county board of elections conducting all local referenda.

authority, or similar public body, however denominated, created by statute or
executive order, as determined and designated by the State Board, except for
those public bodies that have only advisory authority.
