N.R.S. 293.4688 – Access by mobile device to website maintained by Secretary of State; use of mobile device to submit information or forms

Overview of Statute

This section provides duties of the Secretary of State with respect to voting-related internet services, and defines related terms.

Statute

1.  The Secretary of State shall ensure that:

(a) All public information that is included on the Internet website required pursuant to NRS 293.4687 is accessible on a mobile device; and

(b) A person may use a mobile device to submit any information or form related to elections that a person may otherwise submit electronically to the Secretary of State, including, without limitation, an application to preregister or register to vote, a request for an absent ballot and a request for a military-overseas ballot.

2.  As used in this section:

(a) “Military-overseas ballot” has the meaning ascribed to it in NRS 293D.050.

(b) “Mobile device” includes, without limitation, a smartphone or a tablet computer.

Definition [Absent ballot]

A ballot voted by a person who expects to be or is absent from the polling place for his or her precinct or district on election day.

Definition [Military-overseas ballot]

1.  A federal write-in absentee ballot described in section 103 of the Uniformed and Overseas Citizens Absentee Voting Act, 52 U.S.C. § 20303;

2.  A ballot specifically prepared or distributed for use by a covered voter in accordance with this chapter; or

3.  Any other ballot cast by a covered voter in accordance with this chapter.

Definition [State]

A state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands or any territory or insular possession subject to the jurisdiction of the United States.

Definition [Ballot]

The record of a voter’s preference of candidates and questions voted upon at an election. The term includes, without limitation, any paper given to a voter upon which the voter places his or her vote and any electronic storage tapes.

Definition [Person]

1.  A natural person;

2.  Any form of business or social organization;

3.  Any nongovernmental legal entity, including, without limitation, a corporation, partnership, association, trust, unincorporated organization, labor union, committee for political action, political party and committee sponsored by a political party; or

4.  A government, governmental agency or political subdivision of a government.
