N.R.S. 306.080 - Vacancy in office created if no other candidates voted upon in special election

Overview of Statute

This section provides the circumstances in case of a vacancy created by no other candidates voted upon in a special election.

Statute

If any officer is recalled upon a special election and other candidates are not nominated to be voted for at the special election, the vacancy thereby created must be filled in the manner provided by law.

Definition [Candidate]

Any person:

      1.  Who files a declaration of candidacy;

      2.  Who files an acceptance of candidacy;

      3.  Whose name appears on an official ballot at any election; or

      4.  Who has received one or more contributions in excess of $100, regardless of whether:

      (a) The person has filed a declaration of candidacy or an acceptance of candidacy; or

      (b) The name of the person appears on an official ballot at any election.
