N.R.S. 293C.180 – Declaration of nominees: Omission and appearance of names on primary ballot; declaration of single candidate as elected to office

Overview of Statute

This section addresses uncontested primary elections, and other circumstances in which candidates in the primary forgo a primary election and are placed on the general election ballot.

Statute

1. If at 5 p.m. on the last day for filing a declaration of candidacy, there is only one candidate who has filed for nomination for an office, that candidate must be declared elected and no election may be held for that office.

2. Except as otherwise provided in subsection 1, if not more than twice the number of candidates to be elected have filed for nomination for an office, the names of those candidates must be omitted from all ballots for a primary city election and placed on all ballots for a general city election.

3. If more than twice the number of candidates to be elected have filed for nomination for an office, the names of the candidates must appear on the ballot for a primary city election. Except as otherwise provided in NRS 293.400 and subsection 5 of NRS 293C.175, those candidates who receive the highest number of votes at that election, not to exceed twice the number to be elected, must be declared nominees for the office.

Definition [General city election]

An election held pursuant to NRS 293C.115293C.140 or 293C.145. The term includes a general municipal election held pursuant to the provisions of a special charter of an incorporated city.

Definition [Primary city election]

An election held pursuant to NRS 293C.115 or 293C.175. The term includes a primary municipal election held pursuant to the provisions of a special charter of an incorporated city.

Definition [Ballot]

The record of a voter’s preference of candidates and questions voted upon at an election. The term includes, without limitation, any paper given to a voter upon which the voter places his or her vote and any electronic storage tapes.

Definition [Candidate]

Any person:

      1.  Who files a declaration of candidacy;

      2.  Who files an acceptance of candidacy;

      3.  Whose name appears on an official ballot at any election; or

      4.  Who has received one or more contributions in excess of $100, regardless of whether:

      (a) The person has filed a declaration of candidacy or an acceptance of candidacy; or

      (b) The name of the person appears on an official ballot at any election.

Attorney General's Opinions

  • AGO 97-15 (1997) Provisions of the charter of the City of Sparks (see sections 1.010, 1.070, 5.020, 5.030 and 5.050) do not conflict with provisions of former NRS 293.610 (cf. NRS 293C.180) with regard to the placement of an unopposed candidate's name on the general election ballot in the city election. If there is only one candidate for nomination for any city office, that candidate must be declared elected and no election may be held for that office.
