N.R.S. 293B.104 – Secretary of State not to approve system that does not meet federal standards

Overview of Statute

This section requires mechanical voting systems approved by the Secretary of State to meet or exceed Federal Election Commission standards.

Statute

The Secretary of State shall not approve any mechanical voting system which does not meet or exceed the standards for voting systems established by the United States Election Assistance Commission.

Definition [Mechanical voting system]

A system of voting whereby a voter may cast a vote:

      1.  On a device which mechanically or electronically compiles a total of the number of votes cast for each candidate and for or against each measure voted on; or

      2.  By marking a paper ballot which is subsequently counted on an electronic tabulator, counting device or computer.
