N.R.S. 293.287 - Announcement of name and political affiliation of registered voter; challenges; nonpartisan ballot at primary election

Overview of Statute

This section provides for the announcement of name and political affiliation of a registered voter. This governs challenges and allowances for nonpartisan ballots at the primary election.

Statute

1.  A registered voter applying to vote at any primary election shall give his or her name and political affiliation, if any, to the election board officer in charge of the roster, and the officer shall immediately announce the name and political affiliation.

2.  Any person’s right to vote may be challenged by any registered voter upon:

(a) Any of the grounds allowed for a challenge in NRS 293.303;

(b) The ground that the person applying does not belong to the political party designated upon the roster; or

(c) The ground that the roster does not show that the person designated the political party to which he or she claims to belong.

3.  Any such challenge must be disposed of in the manner provided by NRS 293.303.

4.  A registered voter who has designated on his or her application to register to vote an affiliation with a minor political party may vote a nonpartisan ballot at the primary election.

Definition [Election board]

The persons appointed by each county or city clerk to assist in the conduct of an election.

Definition [Political Party]

Any minor or major political party.

The election held pursuant to NRS 293.175.

Definition [Registered voter]

An elector who has completed the procedure prescribed by law for registration as a voter.

Definition [Minor political party]

Any organization which is organized as such pursuant to NRS 293.171.

Definition [Election board officer]

A person appointed to assist in the conduct of an election.

Definition [Board]

As used in NRS 295.075 to 295.125, inclusive, unless the context otherwise requires, “board” means the board of county commissioners.

Definition [Ballot]

The record of a voter’s preference of candidates and questions voted upon at an election. The term includes, without limitation, any paper given to a voter upon which the voter places his or her vote and any electronic storage tapes.

Definition [Roster]

The record in printed or electronic form furnished to election board officers which contains a list of eligible voters and is to be used for obtaining the signature of each person applying for a ballot.

Definition [Person]

1.  A natural person;

2.  Any form of business or social organization;

3.  Any nongovernmental legal entity, including, without limitation, a corporation, partnership, association, trust, unincorporated organization, labor union, committee for political action, political party and committee sponsored by a political party; or

4.  A government, governmental agency or political subdivision of a government.
