N.R.S. 293.205 - Establishment, abolishment, alteration and consolidation; boundaries

Overview of Statute

This section provides for the establishment, abolishment, alteration and consolidation and boundaries of election precincts.

Statute

      1.  Except as otherwise provided in NRS 293.208, on or before the third Wednesday in March of every even-numbered year, the county clerk shall establish election precincts, define the boundaries thereof, abolish, alter, consolidate and designate precincts as public convenience, necessity and economy may require.

      2.  The boundaries of each election precinct must follow visible ground features or extensions of visible ground features, except where the boundary coincides with the official boundary of the State or a county or city.

      3.  Election precincts must be composed only of contiguous territory.

      4.  As used in this section, “visible ground feature” includes a street, road, highway, river, stream, shoreline, drainage ditch, railroad right-of-way or any other physical feature which is clearly visible from the ground.

Definition [County clerk]

Except as the term is used in NRS 293.393, whenever the term “county clerk” is used in this title it means “registrar of voters” in those counties where such office has been created pursuant to the provisions of NRS 244.164.

Definition [Clerk]

The election board officer designated or assigned to make the record of the election in the roster, tally list and challenge list in the precinct, district or polling place in which such officer is appointed.

Attorney General's Opinions

  • AGO 316 (1928) An election precinct may be established within an Indian reservation since the territory of the reservation constitutes part of the state.

  • AGO 284 (1946) Election precincts may be established in the town of Babbitt although the same is located on lands belonging to the United States within the Hawthorne naval ammunition depot.
