N.R.S. 293.193 - Filing fees

This section provides the filing fee schedule for candidates.

Statute

1.  Fees as listed in this section for filing declarations of candidacy must be paid to the filing officer by cash, cashier’s check or certified check.

For the purposes of this subsection, trustee of a county school district, hospital or hospital district is not a county office.

2.  No filing fee may be required from a candidate for an office the holder of which receives no compensation.

3.  The county clerk shall pay to the county treasurer all filing fees received from candidates. The county treasurer shall deposit the money to the credit of the general fund of the county.

4.  Except as otherwise provided in NRS 293.194, a filing fee paid pursuant to this section is not refundable.

Definition [County clerk]

Except as the term is used in NRS 293.393, whenever the term “county clerk” is used in this title it means “registrar of voters” in those counties where such office has been created pursuant to the provisions of NRS 244.164.

Definition [Filing officer]

The Secretary of State, county or city clerk or any other officer authorized by law to receive designations and declarations of candidacy, certificates and acceptances of nomination or any other nomination papers.

Definition [Township office]

An office filled by a township officer.

Definition [Clerk]

The election board officer designated or assigned to make the record of the election in the roster, tally list and challenge list in the precinct, district or polling place in which such officer is appointed.

Definition [State]

A state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands or any territory or insular possession subject to the jurisdiction of the United States.

Definition [Candidate]

Any person:

      1.  Who files a declaration of candidacy;

      2.  Who files an acceptance of candidacy;

      3.  Whose name appears on an official ballot at any election; or

      4.  Who has received one or more contributions in excess of $100, regardless of whether:

      (a) The person has filed a declaration of candidacy or an acceptance of candidacy; or

      (b) The name of the person appears on an official ballot at any election.

  • AGO 125 (1914) Fees required for filing nomination papers must be paid even though there be no contests for nominations to the respective offices to be filed.

  • AGO 243 (1926) A filing fee may not be refunded upon the withdrawal of a candidate.

  • AGO 380 (1930) The fact that a worthless check was given in payment of a filing fee (see NRS 293.193) is not a ground for omitting a candidate's name from the ballot, since a filing officer has the right to insist on payment in cash and is personally responsible if a check is unpaid.

  • AGO 188 (1956) A candidate for office is not entitled to a refund of the filing fee upon withdrawal of candidacy.

  • AGO 666 (1970) In school districts where trustees are compensated for their services, candidates for the office of school district trustee must pay the filing fee prescribed by NRS 293.193.

  • AGO 200 (1976) The provision of NRS 293.193, relating to the candidate filing fee for a district office, does not apply to candidates for the position of general improvement district trustee regardless of whether or not trustees receive compensation.

  • AGO 84-8 (1984) A candidate for the office of public administrator must pay a filing fee as required by NRS 293.193 where he is to receive compensation for holding that office pursuant to NRS 253.050.

  • AGO 86-2 (1986) A candidate for the office of trustee of a general improvement district is a candidate for a district office and is, therefore, required by NRS 293.193 to pay the fee for filing a declaration of candidacy unless the holder of the office for which he is running receives no compensation.

  • AGO 87-13 (1987) For the purposes of NRS ch. 293, a justice of the peace is a township officer (see NRS 293.193), therefore, a candidate for election to the office of justice of the peace must, pursuant to NRS 293.1755, be a resident of the particular township to which the office pertains at least 30 days before close of filing of a declaration of candidacy. If a candidate moves from the township subsequent to filing a declaration of candidacy, a vacancy is created. (See NRS 281.050.)
